§ 1 Scope of the GTC

(1) FLY ROYAL PARAGLIDING David Maier & Denis Maier GbR, Brunnenstraße 10, 87669 Rieden am Forggensee (hereinafter “Fly Royal”) acts as an agent for contracts for paragliding tandem flights (hereinafter “flights”) for other organizers (hereinafter “pilots”). For this purpose, Fly Royal sells tickets and vouchers that entitle the conclusion of separate transportation contracts with the pilots in accordance with these regulations. This brokerage activity of Fly Royal takes place in particular on the websites https://fly-royal.de and https://fly-royal.regiondo.de.

(2) If you purchase products from Fly Royal or redeem purchased products, the provisions of these General Terms and Conditions (hereinafter “GTC”) shall apply.

§ 2 Services provided by Fly Royal

(1) Fly Royal’s service to you consists of brokerage services, namely the sale of an entitlement to conclude a contract of carriage with the pilot or the sale of vouchers for the purchase of tickets. With the sale of tickets and the redemption of vouchers, Fly Royal mediates the flight offer of the pilots. Fly Royal is not the organizer of the flights. The contract of carriage is concluded with the pilot.

(2) Tickets and vouchers can be purchased online via the Fly Royal website and other sales channels. A distinction is made as follows:

(2a) The voucher is a value voucher denominated in Euro (hereinafter “Voucher”), which entitles the holder to use it as a means of payment in the shopping cart of the Fly Royal website within the validity period. Vouchers are exclusively valid for the payment of tickets and cannot be redeemed for additional services (photo & video service, mountain railway ticket). The voucher can be used or redeemed by whoever possesses the voucher data (voucher code). Upon redemption of the voucher (ticket purchase = appointment booking), a personalized ticket for a specific date is issued for the respective flight offer, which is subject to participation requirements. If the nominal amount of the voucher is less than the ticket price, the difference must be paid additionally. If the nominal amount is higher than the ticket price, the difference remains with you as a credit. The credit can be used to purchase further Fly Royal products; a cash payout of the difference is excluded, and the redemption period of the voucher used as a means of payment remains unchanged.

(2b) A ticket is a personalized flight ticket issued by Fly Royal, valid for a specific date, which can be used as a means of payment within the framework of the carriage contract to be concluded separately with the pilot. The ticket exclusively entitles the ticket holder to make use of the flight in such a way that a carriage contract for the flight can be concluded with the respective pilot at the selected flight time – provided that the further requirements are met (in particular, e.g., suitable weather conditions) – and this can be paid for with the ticket. (3) The pilot alone is responsible for the execution of a flight. The flight is carried out on the basis of the contract of carriage, which is concluded with the respective pilot directly on site on the day of the flight. Only the provisions of the pilot’s contract of carriage, in particular the GTCB, shall apply. The fulfillment of the flight on the basis of the contract of carriage is not an obligation of Fly Royal, but of the pilot within the framework of the contract of carriage. A paragliding tandem flight is a challenging sporting event. The prerequisite for the conclusion of a contract of carriage is the fulfillment of the participation requirements, such as basic athleticism/physical agility, no severe overweight (weight limits: min. 30 kg to max. 90 kg body weight) and no restrictions when running. If these requirements are not met, the pilot is not obliged to conclude a contract of carriage. The pilot will assess whether the conditions for participation are met on site at his own discretion. The possibility of carrying out the flight also depends on the weather situation. The assessment of whether the weather conditions are suitable for flying is the sole responsibility of the pilot at his own discretion. If, according to the pilot’s assessment, there is no suitable flying weather, he is not obliged to conclude a contract of carriage. Fly Royal shall inform the customer as soon as possible if the flight is not feasible. As a rule, however, this is foreseeable at the earliest on the day before the planned flight date. However, a cancellation may also occur on the day of the flight itself if the weather situation does not allow the flight to be carried out properly.

(4) The ordering, payment and dispatch of tickets and vouchers as well as the redemption of vouchers are fully digitalized processes. The presentation of printed tickets/vouchers is not required at any time.

(5) Fly Royal also gives you the opportunity to book flights manually (offline booking) without having to buy a ticket or voucher beforehand. Appointment bookings can be made in writing (e-mail, text message) and via the booking functions on the Fly Royal website.

§ 3 Conclusion of contract with Fly Royal

(1) When purchasing a ticket via the Fly Royal website, you enter your data and the data of any other/additional participants in the shopping cart before submitting your order. If you click the “Buy now” button after entering all relevant data and accepting these GTC and the data protection conditions, you submit a binding offer to Fly Royal to arrange the flight through Fly Royal and to have the ticket sent to you or another participant. After submitting the order and thus the respective offer, you will receive an order confirmation by e-mail to the e-mail address provided. The contract with Fly Royal is concluded with this order confirmation. The contract of carriage with the pilot is concluded on the day of the flight on the basis of the GTCB of the pilot already made available here and in the ordering process. The ticket exclusively entitles the person(s) named in the respective booking to conclude the contract of carriage with the pilot.

(2) When purchasing a voucher via the Fly Royal website, you have the opportunity to check all details (e.g. name, address, payment method and ordered items) again in the shopping cart before submitting your order and to change them if necessary. If you click the “Buy now” button after entering all relevant data and accepting these GTC and the data protection conditions, you submit a binding offer to Fly Royal. After submitting the order and thus the offer, you will receive an order confirmation. The contract is concluded with this order confirmation.

§ 4 Prices

The prices offered on the Fly Royal website on the day of the order apply. All prices are final prices in Euro incl. VAT.

§ 5 Terms of payment

(1) Payment of the purchase price of vouchers and tickets (online) is due immediately after conclusion of the contract. You can choose between different payment methods. Detailed information on the payment options can be found on the Fly Royal website under “Payment methods”.

(2) If the booking is made with the payment term “payable on the spot” or if the participant is unable to present a valid ticket on the agreed date, the flight price is payable to the pilot at the start of the flight.

(3) The presentation of a voucher (voucher code) is not accepted as a means of payment on site. Vouchers must be redeemed online when booking an appointment (online booking).

§ 6 Retention of title / withdrawal in the event of non-payment

(1) Tickets and vouchers issued remain the property of Fly Royal until full payment has been made. The entitlement to benefits arising from tickets and vouchers is subject to the condition of full payment.

(2) If the payment already made for a ticket/voucher is canceled after it has been issued, Fly Royal may block the ticket/voucher again. Any further rights of Fly Royal remain unaffected.

§ 7 Right of withdrawal

(1) There is no right of withdrawal when purchasing tickets, as a specific date is set for the provision of the service (Section 312g (2) No. 9 BGB).

(2) When purchasing vouchers, consumers have a right of withdrawal as follows: You have the right to withdraw from the purchase contract with Fly Royal within fourteen days without giving any reason. The withdrawal period is 14 days from the date of delivery of the voucher by e-mail. To exercise your right of withdrawal, you must inform us by means of a clear statement, e.g. an e-mail (FLY ROYAL PARAGLIDING David Maier & Denis Maier GbR, Brunnenstraße 10, 87669 Rieden am Forggensee, +49 160 90339682, info@fly-royal.de) of your decision to withdraw from this contract. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. You can use the following form for withdrawal, but this is not mandatory:

(3) Consequences of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

§ 8 Cancellation / Cancellation of appointments

(1) Cancellations of appointments must be received by Fly Royal in good time and in text form (in writing, by e-mail or text message). The following deadlines and fees apply:

More than 3 days before the flight date: Free of charge (full refund)
Less than 3 days to 24 hours before the flight date: 50% cancellation fee
Less than 24 hours before the flight date: 100% cancellation fee (no refund)

The participant is always permitted to prove that Fly Royal or the pilot suffered no damage as a result of the cancellation, or that the damage incurred is significantly lower than the required flat-rate fee.

(2) The ticket price will not be refunded and will be retained or claimed, in the name and for the account of the respective pilot, as compensation for loss of earnings if the appointment is not cancelled in due time, the participant does not show up for the agreed flight time (no-show), or is excluded from participation due to not meeting the personal participation requirements. Arriving more than 30 minutes late is considered a no-show. In these cases, tickets/vouchers become invalid.

(3) We draw your attention to the possibility of taking out cancellation insurance in the event of accident or illness.

(4) In the event of a cancellation for which Fly Royal is not responsible, due to weather-related, technical or legal reasons, for example due to airspace closures, rescue/police operations, revision of the mountain railroads or for reasons of force majeure, you will receive a refund of the ticket price or the flight price will not be due.

§ 9 Means of payment identity for payment and reimbursement in the event of cancellation/cancellation of appointments

(1) For a refund (including partial refunds), Fly Royal shall use the same means of payment that was used for the original transaction, unless expressly agreed otherwise.

(2) Vouchers used for payment, as well as additional payments made when using a voucher, will be refunded in total as a voucher.

(3) Fly Royal shall not be liable for expenses or damages that you have incurred or may incur in connection with the cancellation of an appointment and/or the use of an alternative date (e.g. travel costs, accommodation, escorts, vacation, etc.), unless the cancellation of the appointment is due to the fault of Fly Royal. This is not the case in particular if the weather conditions do not allow the flight to be carried out properly.

§ 10 Discount codes

Discount codes can be issued as purchase credit or enable the purchase of tickets at lower prices. Discount codes are only valid for the payment of tickets and cannot be redeemed for additional services (photo & video service, mountain railway ticket). Discount codes can only be redeemed once and for a limited time and cannot be combined with other voucher/discount codes. The validity is determined by the respective discount code or the discount conditions. Cash payment of the discount value is excluded.

§ 11 Period of validity / redemption period

(1) Vouchers can be redeemed within the statutory limitation period of three years. This redemption period begins at the end of the calendar year in which the voucher was purchased. The period of validity is entered on the voucher. Expired vouchers will not be extended or replaced.

§ 12 Transferability / loss / risk of misuse

(1) Vouchers and discount codes are transferable. Any person who has knowledge of the voucher data may redeem it. In the event of a transfer, the transferor must refer to the provisions of these GTC.

(2) Tickets are personalized and non-transferable.

(3) Please take particular care with your voucher details, as Fly Royal cannot provide any assistance in the event of loss, suspected loss, theft or misuse of a voucher.

§ 13 Voucher redemption

(1) Vouchers can only be redeemed online via the booking functions on the Fly Royal website. Presentation of the voucher as a means of payment on site is not accepted.

(1a) On the website https://fly-royal.de/tickets/, you can select a flight appointment (date, time) based on the available dates and apply the voucher data (voucher code) in the shopping cart as a means of payment. This will offset the nominal value of the voucher against the total amount of the tickets in the shopping cart. If the booking value is higher than the nominal value of the voucher, the difference is due for payment. If the booking value is lower, the difference remains as a voucher credit. This credit can be used to purchase further tickets, and the redemption period of the voucher used remains unchanged. A cash payout is excluded.

(2) When the voucher is redeemed (appointment booking/ticket purchase), a personalized ticket is created for a specific flight offer on a specific date, which is linked to participation requirements. The person redeeming the voucher must ensure that the participating person fulfills the participation requirements.

(3) After successfully submitting your binding booking request, you will receive a ticket and all important information about your flight by e-mail after confirmation of the booking request. The ticket entitles only the person(s) named in the booking to take part in the flight.

§ 14 Requirements for participation in a flight, additional costs

(1) Participation in a flight requires a minimum level of personal suitability (body weight, age, fitness, health). For details, please refer to the AGBB of the pilots: https://fly-royal.de/agb/#agbb-piloten/

(2) After booking an appointment, you are responsible for ensuring that the person designated as a participant fulfills the participation requirements. A refund of the purchase price after exclusion from participation due to unsuitability of the person is excluded.

(3) Please note that the regular costs for the ascent with the cable car are not included in the ticket. Please refer to the cable car price list for the current prices: https://www.tegelbergbahn.de/

§ 15 Changes to benefits

(1) Fly Royal flight offers are adjusted on an ongoing basis. The same applies to the conditions of participation. Changes must be accepted by the customer if they are reasonable and do not significantly affect the overall experience.

(2) The times given for the duration of flights are for guidance only and are based on experience. The times stated on the Fly Royal website depend in particular on the weather conditions and are therefore non-binding and may vary.

(3) The photographs used in connection with flight offers serve only to illustrate the experience. The images and descriptions are non-binding and may vary.

§ 16 Liability of Fly Royal

(1) Fly Royal is not an organizer, but merely an agent of contracts. Fly Royal is therefore not liable for the provision/execution of the flight. However, Fly Royal shall be liable without limitation within the framework of the concluded brokerage contract in the event of intent or gross negligence, for injury to life, limb or health, as well as to the extent of any guarantee assumed. In the event of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract (cardinal obligation), Fly Royal’s liability shall be limited to the amount of damage that is foreseeable and typical for the type of transaction in question. Fly Royal shall have no further liability. The above limitation of liability also applies to the personal liability of Fly Royal’s employees, representatives and/or bodies.

(2) The brokered pilot is exclusively liable for the provision/performance of the brokered service within the framework of the transportation contract concluded with him.

§ 17 Form of declarations

Legally relevant declarations and notifications that you make to Fly Royal must be made in text form (§126b BGB).

§ 18 Data protection

You will be informed in detail about the type, scope and purpose of the collection, storage, processing and use of personal data by Fly Royal in our privacy policy.

§ 19 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 20 Final Provisions

(1) Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The relevant statutory provisions shall apply in place of the invalid provision.

(2) The place of performance for all obligations is Fly Royal’s registered office.

(3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, Fly Royal’s registered office shall be the exclusive place of jurisdiction for all disputes arising from contractual relationships between the customer and Fly Royal.
